The public broadcaster’s sports desk has viewed a letter from Neethling’s lawyer James Ndebele written to the Director of Public Prosecutions Andrew Chauke, expressing frustration at his delay in dropping the charges against their clients.
A well-placed source has further confirmed to SABC Sport that the letter has indeed been received by the DPP.
“Mr Neethling made representations [through his lawyer]. It's for the DPP to review the decision by the prosecutor and the regional head of the Specialised Commercial Crimes Unit, and the decision will [then] be announced in court,” said the deep throat.
“Technically, it's him giving reasons why he should not be prosecuted.”
Ndebele has always maintained that his clients are just caught in the crossfire in a fight between the 2010 FIFA World Cup Local Organising Committee CEO and SAFA's disgruntled former employees.
It was mentioned at the last court appearance in February that the DPP asked to be given until the first week of March to consider their representations.
The state has already been forced to abandon the theft charges against Jordaan as well as the football association's Chief Financial Officer Gronnie Hluyo, with the withdrawal of more charges potentially damaging their case.
The prosecution did, however, claim a small victory when the defense failed in their bid to have the matter struck off the roll in December, while the case was postponed to the 15th of August, pending Chauke's decision on the matter.
